These Terms & Conditions (“Terms”) govern your use of rockrelaycoms.com and its related pages (the “Website”), operated by RockRelay Systems (“RockRelay,” “we,” “us,” or “our”). By using the Website, you agree to these Terms. If you do not agree, please do not use it.
At a glance
- Using this Website does not create a service contract. A signed quote or service agreement does.
- You are responsible for operating radio equipment lawfully, including any required license.
- Coverage depends on networks, terrain and system design. No system can guarantee uninterrupted service.
- Our systems support team coordination. They are not a replacement for 911 or emergency services.
- Fees, refunds and privacy are covered by your agreement and our linked policies.
Eligibility
You must be at least 18 years old and able to enter into a binding contract to use the Website or purchase our products and services. If you act on behalf of a business or organization, you confirm that you are authorized to accept these Terms for it.
Our services
RockRelay designs, supplies, deploys and supports team communication systems, including cellular push-to-talk, handheld and vehicle-mounted two-way radios, dispatch and team management software, repeaters and site coverage, accessories, training and ongoing support.
The Website describes these services in general terms. The scope, equipment, users, coverage, schedule and price of your project are set out in a separate quote, proposal or service agreement.
Quotes and service agreements
No contract is formed by browsing the Website, calling or emailing us, requesting a consultation or submitting a form. A service relationship begins when you accept a written quote or sign a service agreement.
Quotes are valid for the period shown on them. Equipment and service prices can change with manufacturer and carrier pricing, so we may need to update a quote that has expired. If your agreement conflicts with these Terms, your agreement controls for the products and services it covers.
Your responsibilities
To help us deploy and support your system, you agree to:
- Give us accurate information about your team size, locations, work environment and coverage needs.
- Provide safe, timely access to sites, rooftops, equipment rooms and vehicles where installation or testing is needed.
- Confirm you own the vehicles and property involved, or have the owner's permission for installation work.
- Tell us about site rules, safety requirements or restricted areas our technicians need to follow.
- Review your system at handover and tell us promptly about anything that does not work as agreed.
Radio licensing and regulatory compliance
Many business two-way radio systems must operate under a license issued by the Federal Communications Commission (FCC) or the equivalent authority where you operate. Unless your agreement says otherwise, the license is held in your name and you are responsible for keeping it current and following its conditions.
We can help you identify licensing requirements and prepare applications, and we program radios only on frequencies you are authorized to use. You agree not to reprogram, modify or operate equipment in ways that break radio regulations or interfere with other users. We explain common requirements, but we do not provide legal advice.
Coverage and service availability
Cellular push-to-talk relies on commercial cellular networks, and coverage depends on the carrier and location. Two-way radio coverage depends on terrain, buildings, equipment, and the system design we agree on with you.
We design systems to meet the coverage described in your agreement, but no communication system can guarantee uninterrupted service everywhere. Network outages, power loss, weather, interference, device damage and changes to your site can all affect performance.
Not a substitute for emergency services
Our systems help teams coordinate their work. They are not a replacement for emergency services. In an emergency, call 911 or your local emergency number. If your operation depends on communications for worker safety, talk to us about redundancy, and keep other safety procedures in place.
Fees and payment
- Fees are set out in your quote, agreement or invoice.
- Deposits may be required before equipment is ordered or work is scheduled.
- Invoices are due on the date shown on the invoice.
- Payments are processed by secure third-party payment providers. We do not store full card numbers.
- We may pause work or suspend service on accounts with overdue balances after giving you written notice.
- Unless stated otherwise, prices exclude applicable taxes, licensing and filing fees, and site lease charges.
Service plans and subscriptions
Cellular push-to-talk service, dispatch software and support plans run for the term shown in your agreement and renew automatically for the same period unless you give notice as described in your agreement or our Refund & Return Policy. You are responsible for all usage on the lines and user accounts assigned to your organization.
Equipment ownership and risk
Equipment we supply remains the property of RockRelay until it has been paid for in full. Once paid for, it belongs to you. Risk of loss, theft or damage passes to you when equipment is delivered to you or installed in your vehicles or at your site. Leased or loaned equipment remains ours and must be returned in good working order at the end of the agreement.
Refunds, returns and cancellations
Refunds, equipment returns, cancellations and warranty claims are covered by our Refund & Return Policy and by your service agreement.
Warranties
Equipment is covered by its manufacturer's warranty, and our deployment work is covered by the workmanship warranty stated in your agreement. Warranty coverage does not include damage from drops, water beyond a device's rated protection, misuse, unauthorized programming or modification, or acts of nature.
Accounts, devices and dispatch software
Your system may use push-to-talk apps, dispatch consoles and management portals provided by us or by third parties. You are responsible for managing who has access, keeping usernames, passwords and devices secure, and for all activity under your accounts.
If a device is lost or stolen, or you suspect unauthorized access, tell us immediately so we can help disable it. Third-party platforms are provided under their own terms, and we are not responsible for outages or changes caused by a third-party provider.
Acceptable use of devices and services
You agree not to use our devices or services to:
- Break any law or radio regulation, or cause harmful interference to other radio users.
- Harass, threaten or send abusive content to other users.
- Record or monitor communications where that is not permitted by law.
- Resell or share service with people outside your organization without our written consent.
Confidentiality and privacy
We treat information about your operations, sites, user lists and system settings as confidential. How we collect, use, protect and share personal information is explained in our Privacy Policy.
Intellectual property
The Website and its content, including text, graphics, logos, icons, photos and page design, belong to RockRelay or its licensors and are protected by intellectual property laws. You may view and print pages for your own non-commercial use. You may not copy, republish, modify or distribute Website content without our written permission.
Manufacturer names and trademarks shown on the Website, such as Motorola Solutions, Hytera, Kenwood and Poclink, belong to their owners. Showing them does not imply that any manufacturer endorses RockRelay, and product availability depends on project requirements.
Acceptable use of the Website
When using the Website, you agree not to:
- Break any law or regulation.
- Try to gain unauthorized access to the Website, our systems or another person's account.
- Upload viruses, malware or other harmful code.
- Interfere with the Website's operation or security.
- Submit false information or impersonate another person or business.
- Scrape or harvest content or contact details by automated means.
Third-party links
The Website may link to websites we do not control, including equipment manufacturers, carriers and software providers. These links are provided for convenience, and we are not responsible for the content, products or privacy practices of those sites.
Disclaimer of warranties
The Website is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties about the Website, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy and uninterrupted availability. Warranties for equipment and services are set out in your agreement.
Limitation of liability
To the fullest extent the law allows, RockRelay and its owners, employees and contractors are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, arising from your use of the Website.
Our total liability for any claim relating to the Website is limited to one hundred US dollars (US$100). Liability relating to equipment and services is governed by your agreement. Nothing in these Terms limits liability that cannot be limited by law.
Indemnification
You agree to indemnify and hold harmless RockRelay and its owners, employees and contractors from claims, losses and expenses, including reasonable legal fees, arising from your misuse of the Website or our services, your operation of radio equipment in breach of applicable law or license conditions, your breach of these Terms, or your violation of any third-party right.
Changes to the Website
We may update, suspend or remove any part of the Website, or restrict access to it, at any time and without notice, including for maintenance.
Governing law
These Terms are governed by the laws of the state in which RockRelay's principal place of business is located, without regard to its conflict-of-law rules. Any dispute relating to these Terms will be brought in the state or federal courts serving that location, and you consent to their jurisdiction.
General terms
- Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
- Entire agreement. These Terms and our linked policies are the entire agreement about your use of the Website. Equipment and services are also governed by your quote or service agreement.
- No waiver. Not enforcing a provision does not waive our right to enforce it later.
- Assignment. You may not transfer your rights under these Terms without our consent.
Changes to these Terms
We may revise these Terms from time to time. The “Last updated” date shows the current version. Continuing to use the Website after changes are posted means you accept the revised Terms.
